Terms of Service

Effective date: July 7, 2026

These terms are an agreement between you and Kai By Design ("KBD", "we", "us"), an Ontario, Canada sole proprietorship, covering your use of MovingChecklist (movingchecklist.ca — the "Service").

MovingChecklist has two kinds of users, and these terms address both:

  • Agents — licensed real-estate professionals who hold an account and use the Service to run moving checklists for their clients. Agents are our customers.
  • Clients — people moving, who access a checklist through a private link sent by their agent. Clients never pay us and never create an account.

1. Accounts (agents)

  • Accounts are created by invitation. You must provide accurate information, including your name, email, and real-estate registration details.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • One account seat is for one person. Team plans include a set number of seats; each seat is an individual login.

2. Your clients' data — you are the custodian

  • When you add a client to MovingChecklist, you are entrusting us with their personal information (name, contact details, moving addresses, move details) so we can operate the checklist on your behalf. You remain the custodian of your client relationship and their data; we process it only to provide the Service.
  • You confirm that you have the right to share your clients' information with us for this purpose, and that you will only add clients with whom you have a genuine professional relationship.
  • Emails the Service sends to your clients (the checklist link, weekly check-ins) are sent on your behalf, carry your name, and include an unsubscribe mechanism as required by Canada's Anti-Spam Legislation (CASL).

3. Client access (magic links)

Clients access their checklist through a private link. Links expire after a period of inactivity in the Service's design (currently 120 days from issue) and can be regenerated by the agent at any time. A regenerated link disables the old one.

4. Fees

  • Pilot accounts are free, as stated at invitation.
  • Paid plans, when they apply to your account, are billed at the pricing published on movingchecklist.ca at the time you subscribe, plus applicable taxes (HST). New subscriptions include the stated free-trial period.
  • If we change pricing, existing subscribers keep their signup price where we have said so ("grandfathered"); otherwise we will give at least 30 days' notice before a change affects you.
  • You can cancel anytime; cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to:

  • use the Service for anything other than genuine real-estate move coordination;
  • add people as clients without a genuine professional relationship, or use the Service to send unsolicited commercial messages;
  • attempt to access another agent's or tenant's data, probe or overload the Service, or reverse-engineer it;
  • upload unlawful content or content that infringes someone else's rights.

We may suspend or terminate accounts that violate these terms. Where practical, we will warn you first.

6. Your content and ours

  • Your client records, notes, branding, and message copy remain yours. You grant us the licence needed to store, display, and transmit them to operate the Service.
  • The Service itself — software, design, checklist structure, and documentation — belongs to KBD.

7. Ending your account and your data

  • You may close your account at any time by contacting us.
  • On closure, we will export your client data to you on request, then delete it from the live system within 30 days. Backup copies age out on the backup rotation schedule described in the Privacy Policy.

8. Service availability

We aim for the Service to be available and reliable, but during the pilot and early-access period it is provided as is, without an uptime guarantee or formal SLA. We back up data daily and monitor the Service for errors and downtime.

9. Limitation of liability

To the maximum extent permitted by law: the Service is a coordination tool, not professional advice; you remain responsible for your professional obligations to your clients. KBD's total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these terms excludes liability that cannot be excluded under applicable law.

10. Changes to these terms

We may update these terms as the Service evolves. For material changes we will notify account holders by email at least 30 days before they take effect. Continued use after the effective date is acceptance.

11. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Disputes go to the courts of Ontario.
